Our Firm represented a client in securing a favorable decision from the Hellenic Single Public Procurement Authority (HSPPA – ΕΑΔΗΣΥ). The decision upheld a preliminary appeal related to a tender valued at approximately €20 million for the procurement of medical technology products.
The contracting authority had initially excluded our client during the award evaluation stage, citing concerns that shared management and similar bids with a competitor could suggest a breach of fair competition principles. However, HSPPA annulled the exclusion, ruling that, when doubts arise about the independence of bids, the contracting authority must provide economic operators with the opportunity to demonstrate their autonomy and adherence to transparency requirements before rejecting their offer.
This outcome not only reinstated our client’s bid but also set an important precedent for fair competition and due process in public tenders.
