We are pleased to announce that the Athens Court of Appeals has recently issued a landmark final decision sealing the recognition and enforcement of a London arbitral award in Greece, granting approximately US$2.4 billion in damages to our client, Crescent Petroleum.

This high-profile dispute between Crescent Petroleum and the National Iranian Oil Company is among the most complex and closely monitored international commercial cases to date.

The ruling is particularly significant for its comprehensive analysis of the New York Convention’s requirements for recognizing and enforcing international awards. It exemplifies Greece’s strong commitment to the correct application of the Convention and the robust enforcement of arbitral awards.

A key aspect of the decision addresses sanctions in relation to sanctioned defendants. The Court confirmed that sanctions cannot be invoked by a sanctioned entity to avoid obligations that arose before the sanctions were imposed, reinforcing the integrity of contractual and arbitral commitments even under restrictive measures. Additionally, the Court emphasized that recognition courts do not re-examine the merits of foreign arbitral awards, upholding the principles of finality, limited judicial intervention and friendliness to enforceability for legitimate claims.

Crescent has already enforced part of the award in Greece, demonstrating the practical effectiveness of arbitral enforcement under Greek law.
