Our firm successfully represented a consortium comprised of the Greek company ‘Mytilineos’ and the Spanish company ‘Elecnor SA’ before the Council of State with respect to challenging the results of a tendering procedure of €67m for the installation of an electrification system in a new double-track railway line in the Peloponnese. The Council of State suspended the tendering procedure and held that the contracting authority should have excluded the successful tenderer from participation in the procedure due to its involvement in the infamous case of the “contractors’ cartel” which, for a period of 23 years, were found to have been distorting competition in a series of public tenders in Greece.
